11.1 We own the rights to the content published on Scribble.fish and Scribblefish.com - please do not take it and use it on your own websites or other materials without express written authority
11.2 AUTHORIZATION OF MEMBER CONTENT
The member represents that it not only has the right to authorize the publication of any content it has submitted to ScribbleSpace®, LLC, but that it is fully authorized and licensed to use (i) the names and/or the portraits of pictures of persona, living or dead, or of things: (ii) any trademarks, service marks, copyrighted, proprietary, or otherwise private material: and (iii) any testimonials contained in any content submitted by or on behalf of Member and incorporated by ScribbleSpace®, LLC, and that such content is neither libelous, an invasion of privacy, violating any third party's rights or otherwise unlawful. As part of the consideration and to induce ScribbleSpace®, LLC to use such content, Member agrees to indemnify and hold harmless ScribbleSpace®, LLC against all loss, liability, damage, and expense of whatsoever nature arising out of copying, printing, or publishing of such advertisement or elements.
11.3 USER CONTENT
All creative content elements - artwork, graphics, client’s logos and designs provided to ScribbleSpace®, LLC by Member for use in creative projects, on websites, web app, Facebook page or in printed publications and other materials remains the ownership of the Member. Any content created by ScribbleSpace®, LLC using third party products or services, or any artwork, photos, sound, video, software or other materials obtained from third parties, which is incorporated into creative deliverables, website, apps, Facebook or printed materials (“Third Party Materials”) by the ScribbleSpace®, LLC is the ownership of ScribbleSpace®, LLC. Components and parts that make up the final deliverable that are not provided by the client – remain the property of ScribbleSpace®, LLC to be reused for its own and other client’s work as applicable.
11.4 ERRORS IN CONTENT
On occasion, a detail included in creative design deliverable may not be accurate due to an unintentional error or omission. In such event, or in the event a product is listed at an incorrect price or with incorrect information due to typographical error, technology error, error in the date or length of publication, error in pricing or product information received from our Members, advertisers or suppliers, or for any other reason, you agree ScribbleSpace®, LLC is not responsible for such errors or discrepancies and not responsible to compensate the Member for any perceived damages or loss due to such misinformation. In the end it is the client's responsibility to ensure accuracy of final creative deliverables.
11.5 RIGHTS OF THE AGENCY
ScribbleSpace®, LLC reserves the right to unpublish the Member’s listing if it includes information deemed not suitable to display on our site or if the profile has no data, poor quality data or outdated data. ScribbleSpace®, LLC reserves the right to decline or reject any membership or content for any reason at any time without liability regardless of whether member was previously accepted.
11.6 LIMITATIONS OF LIABILITY
To the maximum extent permitted by law, under no circumstances shall ScribbleSpace®, LLC, its subsidiaries, affiliates, officers, agents, owners, founders, representatives, employees, and contractors, jointly or individually be liable for any direct, indirect, punitive, consequential loss of income or profit, loss of confidential or other information, loss of privacy, personal injury, business interruption, or any other financial loss arising out of use of any services offered by ScribbleSpace®, LLC, or for any incident, indirect, special or consequential damages, even if ScribbleSpace®, LLC has been advised of these damages.
All information, content, services and software displayed on, transmitted through, or used in connection with ScribbleSpace®, LLC (with the exception of User Content as defined below), including, for example, informational text, news articles, blog posts, reviews, directories, guides, text, photographs, images, illustrations, audio clips, video, virtual tours, html, source and object code, trademarks, logos, and the like (collectively, the "Content"), as well as its selection and arrangement, is owned by ScribbleSpace®, LLC and/or its licensors and suppliers. You may use the Content online only, and solely for your personal, non-commercial use, and you may download or print a single copy of any portion of the Content solely for your personal, non-commercial use, provided you do not remove any trademark, copyright or other notice from such Content. If you operate a Web site and wish to link to the Site, you may do so provided you agree to cease such link upon request from the Site. No other use is permitted without prior written permission of the Site. The permitted use described in this section is contingent on your compliance at all times with these Terms.
